Terms and Conditions

Mirrorworld operate a policy of Fairness, Courtesy and Co-operation for all our customers and as such we will strive to resolve customer issues amicably, without having to resort to terms and conditions of sale. However as a business we are obliged have to have them in place.

By placing an order with Mirrorworld via the web site, in person or by telephone you agree to be bound by Mirrorworld Terms & Conditions set out below. If you receive a confirmation email of your order, you must check that the details are correct as soon as possible and you should print out and keep a copy for your records. This confirmation e-mail amounts to an acceptance by Mirrorworld of your offer to buy goods from Mirrorworld and this acceptance is effective regardless of whether or not you receive the e-mail.

Mirrorworld is free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods, any description applied to the goods, the availability of the goods or the order itself.  Price and availability information is subject to change without notice. Certain mouldings used in the production of our mirrors may be unavailable at the time of order. In such circumstances Mirrorworld will use an alternative moulding of equal quality and similar in style. Therefore mirror designs and styles may vary slightly from those shown on the Mirrorworld web site.

Processing Of Order

Mirrorworld now stock 1000's of mirrors for immediate despatch and aim to ship all ready-made items within 2- 3 working days, although some items are made to order and may take upto 7 - 14 days from the date of  your order. A small icon next to the product will tell you whether the item is in stock and also advise you if an item is normally made to order.   Where an order is received for an item that is marked as out of stock we regret we are not able to supply dates when our suppliers may get an item in stock however we will keep you updated by E-mail as to the status of your order (unless you ask us not to) Please note that orders for two or more items, we may part-ship if one or more of the items are unavailable. Mirrorworld aim to make all made-to-measure mirrors within 14 - 21 days, however in rare cases this may be exceed due to circumstances beyond our control.  Where an item is delayed we will do our best to keep it to the minimal as we can.

Please note, in the case of bespoke framed mirrors you have the opportunity before placing any order to request a small sample of your preferred frame mouldings, enabling you to see first hand the colour, size and style of the frame moulding you have chosen. If a sample is requested we will contact you shortly after it has been dispatched to confirm your order requirements. Unfortunately, we are unable to accept cancellations of bespoke orders after this point. Note: Where carriage is charged, this will be shown on your invoice as a separate service and deemed complete upon your receipt of the goods.

Mirror Adhesive Disclaimer: MirrorWorld supply only premium quality glass mirrors using either Pilkington Optima, Guardian Ultra or similar quality glass mirrors that meet EN1036 standards.   Our website offers specialist mirror adhesives that is suitable for use with both these products and will not cause any adverse effects to the mirror.

When purchasing your own mirror adhesive, please make sure that it is suitable for use with the above glass mirrors.  If in doubt please refer to the manufactures guidelines of the mirror adhesive.

We also provide mirror adhesive for use with acrylic mirrors.  This has been designed not to harm the mirror or the plastic of the acrylic mirrors we sell and as such is recommended.   If you purchase your own mirror adhesive, please make sure that it is suitable for use with plastic mirrors.  If in doubt please refer to the manufactures guidelines of the mirror adhesive.

Mirrorworld strongly advise the use of the mirror adhesive we provide, when hanging our mirrors as they have been stringently tested by the manufacturers and will not cause damage to our mirrors.   Unfortunately Mirrorworld will not accept liability for damage caused to mirrors where the third party adhesive has been use and/or where the manufacture guidelines for hanging the mirror have not been followed.

It is highly recommended to follow our guideline as we know from experience that not all mirror adhesives are alike.

Please note: Whilst smaller mirrors will normally fix to the wall in 5 - 10 mins  Medium sized mirror can take  a little longer and we generally recommend the use of temporary tape or painters tape to hold the mirror whilst the glue dries. 

As mirror Adhesive can take up to 24 hours to completely dry we advise the use of a firm baton under the mirror to carry the mirror's weight whilst the adhesive dries.   Once the glue has dried you can remove the baton.

When ordering a bespoke mirror with a heat pad, the clearview pad number given on the screen is only an advisory as we will need to check your order to ensure that it will fill and in some cases may need to make an adjustment.

 

Delivery Policy

Mirrorworld will give you notice of a scheduled (or otherwise agreed) delivery date, to allow you to make the necessary arrangements to receive the mirror. MirrorWorld will not accept liability for arrangements that you have made to receive or return your mirror. The delivery team can wait while you check your mirror for damages, where this is not possible please ensure you contact us within 72 hours of receipt of delivery if there are any issues with your order. Please note due to the nature of the product, we cannot accept responsibility for damages reported after this period. In the event of a delivery being delayed or cancelled due to circumstances beyond our control, we will offer a delivery date as close as possible to the original agreed delivery date. NB: This includes extreme weather conditions such as Snow and Floods, that may cause further delays to your delivery. Where a delivery date has been advised but the Buyer isn’t present to receive the delivery we reserve the right to charge the customer a minimum of £25 to cover part of the cost of the failed delivery and redelivery. We advise all customers to sign, "NOT CHECKED" with the carrier if you have any doubts about damage upon delivery.

Delivery Options

Free Delivery - Free delivery offers ONLY applies to Standard UK mainland, for Ready Made order values over £50.00 on a 5 - 7 day service.

Premium Deliveries

Non Standard or other delivery destinations such as Scottish Highlands, Northern Ireland, IOM, Channel Islands, & Eire etc will be subject to a delivery surcharge as these require a premium delivery service. (Please ask for further details)

AM Delivery - We can offer a pre 12pm delivery.  This applies to Standard UK mainland, and excludes Non Standard or other delivery destinations such as Scottish Highlands, Northern Ireland, IOM, Channel Islands, & Eire etc which will be subject to a delivery surcharge. (Please ask for further details)

48 Hour Delivery -  if taken, your order will be despatched within 48 hours* on all stock items under 1400mm in size and all made to measure mirrors of any size from the date they have been completed**.  This applies to Standard UK mainland; unfortunately we cannot offer this service to Non Standard or other delivery destinations such as Scottish Highlands, Northern Ireland, IOM, Channel Islands, & Eire etc which will be subject to a delivery surcharge. (Please ask for further details)

* Orders received after 5.00pm and orders received over the weekend will be processed the next working day.  This option relates to despatch only and does not guarantee delivery within 48hrs.   New customers requiring delivery to an alternative address to the billing address will have to provide a passcode before any item can be delivered.  This letter is despatched the same day the order is received except out of hours or weekends when the letter will be sent on the next working day.

** Please note: This does not guarantee for bespoke mirrors to be made within 48hours but only that they will be despatched within 48hours of completion.

Saturday Delivery - For £25.00 we can deliver your order on the next available Saturday that your order is ready to be despatched.  (Orders received after 2pm on Friday will be despatched on the following Saturday).  This option applies to Standard UK mainland; unfortunately we cannot offer this delivery to Non Standard or other delivery destinations such as Scottish Highlands, Northern Ireland, IOM, Channel Islands, & Eire etc which will be subject to a delivery surcharge. (Please ask for further details   unfortunately we cannot offer a Saturday delivery on oversized mirrors, however if a premium delivery service is required we may be able to accommodate your needs, please ask our sales team for details.


Delivery Assistance

In order that we can offer as competitive rate for deliveries as possible on our mirrors, our vehicles are manned by only one person. The driver will unload the goods for you; however, we will need you to provide suitable help in the unloading of mirrors with any length over 1.3 meters. If you are unable to do this, we can provide a second person at an additional charge but must be contacted in advance for a quote. Please note, if you have not informed us in advance and you are unable to provide assistance for these larger mirrors, we will need to redeliver at another time and you will be required to pay an additional delivery charge.

Our delivery team can happily unload to a ground floor room, however they are not insured to deliver above ground floor as our insurers will not cover this.  As such we regret that they can not deliver to any upstairs rooms nor can they collect from them.

Cut to Size

For your convenience and safety, all large cut-to-size mirrors and other sheet glass products will be delivered by our own vehicles at a pre-arranged delivery date. In some parts of the country deliveries may be made by third party agents on our behalf. If your property has any access restrictions for larger vehicles, you should inform us of this prior to placing the order. Accordingly any delivery lead time quoted will be indicative only and time will not be of the essence for this contract. In particular the default 30 days for contract performance under the United Kingdom’s The Consumer Rights Act 2015, shall not apply. We will not be liable for any loss or damage suffered by you through delay in delivery. Unless you tell us you wish to collect the goods, we will deliver them in accordance with your order. We make every effort to deliver the goods within the expected timetable; however delays are sometimes inevitable due to unforeseen circumstances. Deliveries to customers living in remote regions may take a little longer.

Our Art Deco and bespoke range of mirrors are made to order and therefore can take 21-28 days from receipt of your order and payment to be made. The majority of these mirrors will be delivered by our own vehicles at a pre-arranged delivery date.

As with all deliveries, please ensure that you open the packaging and check that there is no damage within 24hrs

Payment

We accept a broad range of payment types from paypal to visa, MasterCard, Amex, Maestro and JCB. Your order will only be processed subject to payment being authorised. Please note that the payment transaction will take place prior to delivery. Mirrorworld uses World Pay, paypal and google checkout for online credit and debit clearing.  The Transaction will normally appear on your statement as Mirrorworld. For your convenience we are also able to take payments by cheque, phone, fax or mail. Please make bank cheques payable to: Mirrorworld.

Credit and debit cards are debited before items are shipped by Mirrorworld. All prices include sales taxes (where applicable) unless otherwise stated. Shipments to your delivery address maybe subject to import duties and taxes which are levied once a shipment reaches your country. Any such additional charges to clear customs must be borne by you. You should note that customs policies vary widely from country to country so we advise that customers contact their local customs office for further information. Note that international shipments are subject to opening and inspection by customs authorities.

Manufacturing Tolerances

With all handmade items made to measure there are certain manufacturing tolerances that come in to play, especially with wood mouldings. When Cutting heads wear this leads to moulding dimension changes which in turn can result in a slightly different overall frame size. These tolerances apply to all mirrors and frames and are normally kept to a minimum but 5-15mm is not uncommon and is deemed as within our manufacturing tolerance. 

Should you require a more accurate size within 3-5mm where for example a frame must fit into a recess please ensure this is requested at time of order, as sizes within our normal tolerance range will not be rectified. Where differences exceed sizes in our normal tolerance range, the will be replaced under our 100% satisfaction guarantee scheme.

The size for all our readymade mirrors is given as an approximate size and can vary slightly, please bear this in mind when fitting into tight spaces or recessed etc.

Please note: Certain Mirrors are described as Aged, shabby or Antique Effect.  These mirrors are deliberately distressed so that they are in keeping with that particular mirrors design.  As each mirror is made independently the distress shown might vary from the photograph on our website, if in doubt please contact our sales team on 0333 800 8181.

Natural Wood Disclaimer: If you are purchasing any of our natural wood products please be aware as with all solid wood - natural flaws, minor imperfections, knotting, colour and grain variances may also be present in the wood.

Acrylic Advisory Note: Acrylic mirror sheet does not have the rigidity of glass and is not offered as a direct replacement for applications where glass mirror may be more suitable.  During normal use, visual distortion may occur - such distortion may be exaggerated when using larger pieces. A thicker piece of acrylic mirror will be less flexible and therefore maintain better optical integrity. Correct installation and sufficient material thickness can reduce visual distortion but will not completely eliminate it.  

Visual distortion is not a manufacturing fault but an inherent characteristic of the material.   It is important that you satisfy yourself of the materials suitability for your particular application before use.  Please ask for more details if this is not clear, as we CAN NOT offer refunds based on the natural properties of the product.

Important note Due to the nature of this product, there may be minor marks in the mirror for full details please see our Acrylic Mirror and Two Way Mirror Finish Surface fact sheet. 

In respect of the Art Deco Mirrors with coloured panels, please note that no two mirrors are the same.  This is because the hand crafted nature that makes the stained glass effect gives a different finish each time, with each colour, style and shade varying slightly.   Any art Deco image is only show as indicative of the colour only i.e. Green, Red etc 

In respect of two way mirror or tv mirror, samples can be provided and are available on our website so that you can ensure that the two way mirror or tv mirror is suitable for it's intended purpose in the environment provided.

Reporting and Returning Damaged Items

In the unlikely event your mirror arrives with a fault or defect, please contact our customer support team by no later than seven days of receipt of your mirror by email at support@mirrorworld.co.uk enclosing a photograph of the defect or fault if possible or by writing to us at Mirrorworld, Unit 3 Deans Road Trading Estate, Swinton, Manchester, M27 0RD where we can offer replacement or refund. 

All Damages must be reported via email to support@mirrorworld.co.uk or in writing to Mirrorworld within 3 days (Except Art Deco and Bespoke mirrors that must be reported within 24hrs of delivery). Faulty and damaged mirrors will be replaced free-of-charge.   Due to the nature of this material, Mirrorworld cannot accept responsibility of damage to a mirror once it has been fitted.  Unfortunately any claims of a damaged mirror after it has been fitted will therefore be rejected.  

Should you not require a replacement, please confirm this in writing when reporting the damage and make arrangements to return the mirrors to us. Unfortunately we do not accept returns for bespoke items and where damage has been reported within the set time these items will be replaced.  

Cancellation Policy

We want you to be completely satisfied with your purchase. Under the Mirrorworld 100% Satisfaction Guarantee, you have the right to cancel your order within 14 days of receipt of your mirror by you or a third party (excluding the carrier) This policy refers to ready-made frames only and does not apply to any bespoke mirrors including all our art deco mirrors and all made-to-measure mirrors which include glass, acrylic and steel products cut to size supplied under our bespoke manufacturing service.  Unfortunately such mirrors are non-returnable and non-refundable. 

Special Notes: All our "Standard size with personalised" range are also treated as a made to measure, as whilst we use Standard size mirrors, each frame and assembly procedure is produced and completed to order. 

 
In the event that you wish to cancel your order prior to any commencement of work, you should do so in writing (or by email to support@mirrorworld.co.uk) please, within 14 days*. A full refund will be issued, unless a premium delivery service has been requested. In such instances a refund will be made less any charges incurred in processing your premium delivery.   

Your statuary rights are not affected

*If you have already taken delivery of your goods or they have already been despatched and you want to cancel your order please refer to our section return of unwanted goods below.   

Return of Unwanted Goods

This does not apply to Bespoke orders or standard size mirrors with personalised frame.    In the unlikely event of you wanting to return your mirror, it should be returned undamaged** and in it's original condition and appropriate packaging to ensure its safe arrival at Mirrorworld. All returns are inspected on arrival and we regret that refunds cannot be issued if the goods are found to be damaged. Please return the mirror to the address specified below. We will refund the full*** amount paid for the goods (including VAT) within 14 days of receiving the returned your mirror. Special Note: If you wish to return unwanted goods we strongly advise you to send your package by registered post or courier and to maintain sufficient insurance to cover the value of the goods. We cannot be held responsible for goods lost or damaged in transit when returning.

**Where the goods are returned and their value has diminished because they have been handled beyond what is necessary to confirm normal satisfaction of a product then in accordance with the regulations and our terms and conditions a charge may be deducted from any refund.  Where an item has been returned damaged and therefore unsalable then the item will either be rejected and returned back to the customer or the refund denied.  This excludes any damages reported prior to the return not caused by the buyer. 

***We will only refund standard shipping costs i.e. where a delivery is under £50.00 and a charge of £4.95 has been paid.  We do not offer a refunds of any premium delivery service taken i.e. saturday, timed deliveries, Highlands, Northern Ireland or Republic of Ireland deliveries. These charges if applicable will be deducted from the total refund amount.  

If you wish to cancel or postpone your fitting date within three working days of the due date, we will incur costs therefore cancellation or postponement may be subject to an administration charge.

Reporting Damages of Made to Measure Goods

All Damages must be reported to Mirrorworld within 24hrs of delivery via email at support@mirrorworld.co.uk or in writing.   Due to the bespoke status of these mirrors, items that are delivered and signed as being received in good condition will not be replaced if the damage is not reported within 48hrs.   

Please note in accordance with our cancellation policy and the Consumer Rights Act 2015, we cannot offer refunds on bespoke items. In the unfortunate event that an Art Deco or bespoke mirror has been damaged in transit, please ensure that you advise us within 48 hrs of delivery at support@mirrorworld.co.uk or by telephone on 0333 800 8181 so that we can make arrangements to organise a replacement mirror.

Exchange of Goods

If having received your mirror and decide you would prefer an alternative choice of mirror, please make arrangements to return the mirror us in perfect condition within seven days and contact us on 0333 800 8181 (press 1 for sales) to discuss your new requirements.

Please note we cannot offer exchange of goods on made to measure items such as Art Deco, glass, acrylic, cut to size or our standard size with personalised framed mirrors

Dutch Auction

A bid on the Mirrorworld Dutch Auction is considered a contract and you're obligated to purchase the item. Please note we do not offer a cancellation policy for our Dutch auction sales, If your mirror arrives damaged please refer to the Return of Damaged Goods section in our terms and conditions.

Gift Voucher Terms and Conditions
Purchase of Gift vouchers
  • Full payment must be made before vouchers are dispatchedWhenever possible gift vouchers will be dispatched by chosen delivery type on the next working day following the day the order was placed.
  • The purchaser will be given the option to specify the redeemer’s name.
  • Security checks will be made to ensure any vouchers is either the redeemer’s name or authorised by the purchaser.
Redemption of Gift Vouchers
  • Gift vouchers must be redeemed within two years of purchase.
  • This gift voucher can only be redeemed against products shown on the Mirrorworld website: www.mirrorworld.co.uk
  • Gift vouchers should be treated like cash. They cannot be replaced if lost or stolen.
  • This gift voucher cannot be exchanged for cash & is non-returnable or transferable.
  • Vouchers which are defaced, altered, void or cancelled will not be accepted.
  • This gift voucher may be exchanged for products of a lower or equal price than the face value on this voucher. Higher face value items can be exchanged with an additional balance payment.
  • This gift voucher is redeemable in the UK; we can deliver to addresses in the Channel Islands and the Scottish Isles at an additional cost.
  • We are currently unable to deliver to other international addresses.
  • We reserve the right to change the Terms and Conditions at any time.
Change and Refunds
No change will be given if the value of goods/services purchased is less than the value of the gift voucher(s) used If a purchase paid by gift vouchers is cancelled or returned, the refund (minus the cancellation fee) will be given in the form of online voucher(s). If a purhcase involves payment by gift voucher and another form of payment, the cancellation fee will be taken from the non-voucher element as far as possible.
Discount vouchers, Tokens and Discount Codes
Vouchers can only be used online at Mirrorworld.co.uk and mirrors4home.co.uk subject to these terms and conditions, and any other specific conditions notified to you on the issue of a voucher. Your use of a voucher indicates your agreement to be bound by these Voucher Terms and Conditions. We reserve the right to withdraw, vary or cancel a voucher for any reason at any time. Vouchers may be limited to redemption in respect of certain products or services or certain products or services may be excluded from the ambit of use of the voucher, in which case notice will be given to you at the time of issue of the voucher. Vouchers are, and remain at all times, the property of Mirrorworld Ltd. The right to use a voucher is personal to the original recipient and may not be transferred. No voucher may be copied, reproduced, distributed, or published directly or indirectly in any form or by any means for use by an entity other than the original recipient, or stored in a data retrieval system, without the prior written permission of Mirrorworld Ltd. Vouchers distributed or circulated without the written approval of Mirrorworld Ltd, for example on an Internet message board or on a "bargains" website, are not valid for use and may be refused or cancelled. Unless expressly stated otherwise at the time of issue of the voucher, each issued voucher will be valid for use by a recipient only once. A voucher may not be used in conjunction with any other special offer or voucher. Vouchers cannot be exchanged for cash. Where an online offer states that a percentage discount will be given on a purchase, the cost of the qualifying purchases will be reduced by the stated discount percentage. Supplementary charges such as delivery charges shall not be discounted unless specifically stated in the offer description. When you use a voucher you warrant to Mirrorworld Ltd that you are the duly authorised recipient of the voucher and that you are using it in good faith. If you redeem, attempt to redeem or encourage the redemption of vouchers to obtain discounts to which you or a third party are not entitled you may be committing a civil or criminal offence. If we reasonably believe that any voucher is being used unlawfully or illegally we may reject or cancel that voucher and you agree that you will have no claim against us in respect of any rejection or cancellation. If we refuse a voucher submitted as part of an order, for any reason, we will inform you before the order is dispatched to advise of the correct cost of the order and give you the opportunity to cancel the order. The failure of Mirrorworld Ltd to take any action in respect of a breach of these terms and conditions shall not constitute a waiver of their enforceability. Mirrorworld Ltd reserves its rights in respect of these terms and conditions at all times. A voucher is redeemed by providing a code at the appropriate point when placing an order over the telephone with our sales advisors. Redemption may be subject to you providing proof of entitlement to use the voucher. Vouchers are not currently able to be redeemed when paying via online.  Where Buy Two Mirrors get Third Half price is offered, the 50 percent discount will apply to the lower cost mirror only.
Fitting and Surveys
Customer Obligations

1.1 The Customer shall:

(a) Be responsible for any obstructions i.e. Electrical sockets etc which may hamper the installation of the mirrors and to replace them after installation completed.

(b) It is the responsibility of the customer to provide such access to the Customer’s premises and other facilities as may reasonably be for the purposes of the installation; the customer should ensure that there is adequate access in order for the mirrors to be installed safely. Should access not be adequate there will be further charges for the mirrors to be cut down and returned to site to be installed.

(c) Assist the fitting team or Mirrorworld with any reasonable request that the Customer considers reasonably necessary, in order to install the customers mirrors in a timely manner, and ensure that it is accurate in all material respects.

(d) Inform Mirrorworld of all health and safety rules and regulations and any other reasonable security requirements that apply at any of the Customer’s premises;

(e) The Customer shall indemnify Mirrorworld and keep it indemnified against all damages, losses, costs, claims and expenses incurred by Mirrorworld and arising out of the failure of the Customer to comply with its obligations pursuant to these Conditions.

(f) In the event that any claim shall be made against Mirrorworld by any third party in respect to any loss or damage or alleged loss or damage arising in connection with the Service or Goods delivered, the Customer will fully and effectually indemnify Mirrorworld in respect thereof. 

(g) It is the responsibility of the customer to ensure that the correct mirror sizes are given.

(h) The customer shall be responsible for the disposal of any mirrors removed from the walls unless specifically agreed by Mirrorworld and charged separately.

(i) Where a clearview pad has been supplied with the mirror, it is up to the customer to make their own arrangements to have this installed by a qualified electrician.   Installation of a mirror does not include installation of any electrical equipment.

(j) If the customer needs to cancel the installation date Mirrorworld require that at least 48 hours written notice (Monday to Friday) is given so that our subcontractors have time to rearrange their own schedules and not incur losses.  Where notice is given outside our office hours i.e. after 5.30pm Monday to Friday or at weekends then notice will be considered being given on the next working day.  Where satisfactory notice of a cancellation is not given within the required time then any additional costs incurred as a result will be passed onto the customer.

Survey

2.1 A survey for measure up or fitting advice should only be booked where the area of installation has been built and/or is accessible. We are unable to advise on parts of the property which are covered, unexposed or inaccessible and cannot give an opinion thereon. Where a surveyor attends site and is unable to measure or provide advice on the area concerned due to the above then mirrorworld will not be liable for refund of the survey and any revisit will be chargeable.

2.2 Where a survey is requested after an initial order has been received and alterations are required then any additional costs are to be bore by the customer.

2.3 Furnishings, fittings, personal effects and storage will not be moved and no action will be taken which in the surveyor’s opinion could cause damage to the building, compromise safety, or which is against the wishes of the owner/occupier of the building or their appointed representatives.

2.4 Surveys should only be booked to either provide installation advice or measure up service. Any further requirements should be discussed with our sales team.

Mirrorworld Responsibilities

3.1 Mirrorworld shall manage, complete and provide the Goods and/or Services to the Customer

3.2 Mirrorworld shall co-operate with the Customer in all matters relating to the supply of the Goods and/or Services;

3.3 In relation to the provision of the Services ensure that Key Personnel are suitably skilled, experienced and qualified to carry out the Services and ensure that Mirrorworld’s Team use reasonable skill and care in the performance of the Services.

3.4 All fitting teams should observe all health and safety rules and regulations and any other reasonable security requirements that apply at any of the Customer’s premises.

3.5 Mirrorworld will notify the Customer as soon as it becomes aware of any health and safety hazards or issues which arise in relation to the provision of the Goods and/or Services;

3.6  Installation appointments may be scheduled to take place during normal business hours Monday to Friday, subject to the availability of an Installer.

3.7 We will make every effort to complete the Installation on time and within the agreed time slot.  Where this isn’t possible, we will endeavour to give you as much notice as possible and rearrange the appointment with you.  Please allow for a 60 minute arrival window due to traffic conditions etc.

3.8 We  may  have  to  suspend  the  Installation  if  we  have  to  deal  with technical problems or other issues (for example, asbestos). Where this is the case, we will inform you immediately. We will not be liable or responsible for any failure to perform, or delay in performance of, the Installation where this is caused by an Event Outside Our Control, meaning any act or event beyond  our  reasonable  control,  including  without  limitation  sickness,  dreadful  traffic  or weather  conditions  or  something  similar.  If  an  Event  Outside  Our  Control  takes  place  that affects the performance of our obligations under these terms, we will contact you as soon as reasonably possible to notify you and we will endeavour to provide the Installation as soon as reasonably possible.

3.9 We will endeavour to provide the Installation without causing unnecessary damage to your property, but please be aware in some cases due to the type of the Installation or work required there  may be damaged caused around the area  of  installation  and  that  you  may  need  to  redecorate.   For example if we were removing an existing mirror from the wall or when fitting oversized mirrors with adhesive which may require a baton support whilst the glue dries..  In the latter case, we will return to remove the baton and fill any holes left in the wall.  We would not carry out any construction or replace any original surface.  Nor would we carry out any further decoration including but not exclusively painting and wall papering.  Any further repairs to the surface would become the customers responsibility, unless we have been negligent.


Changes and variations

4.1 If Mirrorworld requests a change to the scope of the installation, the Customer shall not unreasonably withhold or delay consent to it. If the Customer wishes Mirrorworld to proceed with the change, Mirrorworld shall do so, following a variation of this agreement in accordance with Condition 3.2. Unless Mirrorworld’s request was attributable to the Customer’s non-compliance with the Customer’s obligations, neither Mirrorworld’s charges nor any other terms of this agreement shall vary as a result of such change.

4.2 In the event of time overruns, should a fitter be unable to complete the work required within the given time slot, the client will be notified BEFORE work is carried out, work will only be undertaken over the predetermined time slot with the clients full understanding and consent, on these very rare occasions the extra time will be billed separately.

4.3 All sundries and fixings required to complete your installation are fully inclusive within the quotation price. i.e. Screws, fastenings and adhesive where applicable. 4.4 In the unlikely event that any materials are required to make good prior to installation or materials required during installation e.g. Timber supports that are not itemised in the original quotation will be charged as a separate item.

4.5 Where the requested survey is for the purpose of a quotation, a minimum charge will be levied, should the quoted job proceed, some or all, of the survey fee will be credited against final cost.

4.6 Final quotation over £1500 fee credited in full on completion, final quotation over £750 fee credited 50% on completion, final quotation over £300 fee credited 25% on completion and final quotation under £300 no credit given

Termination of Installation

5.1 In the event of any of the following Mirrorworld may forthwith (by written notice) terminate the Contract:

Entry by the Customer into a deed of arrangement; Failure by the Customer to comply with any statutory demand served in it under the Insolvency Act 1986; The making of a voluntary arrangement between the Customer and its creditors under the Insolvency Act 1986; The obtaining of any judgment against the Customer or the levying of distress or execution on any premises owned or occupied by the Customer; The appointment of a receiver (whether by the Court or out of Court) of the whole or any part of the Customer’s property; The presentation of a petition for the winding up of the Customer or for the appointment of an administrator; or The commission by the Customer of any breach of any contract with Mirrorworld for the supply of Services and/or Goods or otherwise. In the event of any Contract being terminated in accordance with Condition 5.1, all invoices or amounts outstanding will become immediately due and payable by the Customer; Mirrorworld shall not be liable for any loss or damage whatsoever incurred by the Customer arising from cancellation or termination in accordance with this Condition 5.

5.2 Installation bookings accepted by Mirrorworld can only be cancelled by the customer with the written consent of Mirrorworld, such consent to be in Mirrorworld’s absolute discretion and then only upon payment of a reasonable cancellation charge which shall include expenses already incurred or committed and shall take account of related commitments made by Mirrorworld.

Liability

To the extent not prohibited by law, we accept no liability for any:

6.1 loss which is not foreseeable (loss is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time you and we entered into our agreement);

6.2 loss which arises when we are not at fault or in breach of our agreement; and business loss (which includes loss of profits, loss of business, contracts, goodwill, business opportunity and

other similar losses).

6.3 Defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow Mirrorworld’s instructions (whether oral or in Writing), misuse or

alteration or repair of the Goods without Mirrorworld’s approval;

6.4 All installations are carried out at customers own risk, we will not be responsible for any damage that may occur during installation due to incorrect sizes, inadequate access etc.

6.5 Subject as expressly provided in these Conditions, and except where the Goods are sold to a person dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977),

all conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.

6.6 Mirrorworld shall have no liability to the Customer for any loss, damage, costs, expenses or other claims for compensation arising from any Document or instructions supplied by the

Customer which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or arising from their late arrival or non-arrival, or any other fault of the Customer

6.7 Mirrorworld shall have no liability to the Customer for any loss, damage, costs, expenses or other claims for compensation arising from any Document or instructions supplied by the

Customer which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or arising from their late arrival or non-arrival, or any other fault of the Customer.

6.8 You may have certain legal rights regarding claims in respect of losses caused by our negligence or failure to carry out our obligations. Nothing in our agreement is intended to limit

your legal rights as a consumer. For further information about your legal rights you can contact your local authority Trading Standards Department or Citizens Advice Bureau.

6.9 Except in respect of death or personal injury caused by Mirrorworld’s negligence, or liability for defective products under the Consumer Protection Act 1987, Mirrorworld shall not

be liable to the Customer by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms

of these Conditions, for loss of profit or for any indirect, special or consequential loss or damage, costs, expenses or other claims for compensation whatsoever (whether caused by the

negligence of Mirrorworld, its employees or agents or otherwise) which arise out of or in connection with the supply of the Goods and/or Services (including any delay in supplying or

any failure to supply the Goods and/or Services or at all) or their use or resale by the Customer, and the entire liability of Mirrorworld shall not exceed the price of the Goods and/or

Services, except as expressly provided in these Terms.

Force Majeure

7.1 Mirrorworld shall not be responsible for failure to perform under these Conditions if caused by circumstances out of its control, including but not limited to fire, strike, government order, act of God, act or war or terrorism, extraordinary act of nature, court orders, unavailability of supplies, parts or power.

7.2 In the event of an occurrence as mentioned above Mirrorworld shall have the option in its absolute discretion of canceling or suspending all or any of the supply Services and these shall be no liability whatsoever on Mirrorworld as a result of such cancellation.

Assignment/Sub-Contracting

8.1 The Customer may not delegate or assign any duties or rights under these terms without Mirrorworld’s prior written consent. Any unauthorized delegation or assignment in violation of this Condition is void and Mirrorworlds shall have no obligations towards such parties.

8.2 Mirrorworld reserves the right to delegate or assign any duties or rights under these terms. For the avoidance of doubt this includes delegation of its Services obligations to a third party contractor.

Rights of 3rd party

9.1 A person who is not party to the Contract has no rights to enforce any term of this Contract under the Contracts (Rights of Third Parties) Act 1995.

Limitations of Authority of representatives

10.1 Changes to these Conditions shall be binding only if confirmed in writing by Mirrorworld’s duly authorised officer.

Jurisdiction

11.1 As per our main terms and conditions, the above shall be governed by English Law and any dispute arising out of or in connection with them shall be determinable only in the Courts of England and Wales. For the avoidance of any doubt these Conditions shall not be governed by the provisions of the United Nations Convention on Contracts for the International Sale of Goods.

LIABILITY GUARANTEES AND WARRANTIES FOR COMMERICAL CUSTOMERS
(i) Without prejudice to the operation of any other condition herein any liability of the Seller shall be limited to and not exceed a sum equal to the purchase price of the defective, or damaged, or undelivered goods which give rise to such liability as determined by the net price invoiced to the Purchaser in respect of any occurrence or series of occurrences. In particular, the Seller shall not be liable for loss of profit caused to the Purchaser by a breach of contract on the part of the Seller or for any other consequential loss to the Purchaser howsoever caused.
(ii) Except where otherwise provided herein the Seller gives no guarantee or warranty in respect of goods supplied by the Seller in addition to those given by the manufacturer of such goods, and accepts no liability and gives no warranty in relation to defects in such goods, and in particular, but without prejudice to the generality of the foregoing, the Seller does not accept any liability in respect of fitness for purpose quality or merchantability of such goods, whether express or implied, statutory or otherwise. The term “satisfactory quality” implied under the Sale and Supply of Goods Act 1994 in contracts for the sale of goods relates to consumer law and shall be expressly excluded from all such contracts, which the Seller enters with the Purchaser.
(iii) The Seller will at its absolute discretion repair or replace any goods supplied by it, or refund the purchase price, which are defective in materials or workmanship at the time of delivery or collection provided that such defect would not have been apparent on inspection, and notice has been given of such defect within 14 days of the date by which the Purchaser could first reasonably have ascertained that such defect existed, and within two months of delivery or collection, and the Purchaser or end-user has not dealt with the goods in such a way as to render their condition worse than when they were delivered.
(iv) The Seller shall not be liable for any loss, damage or liability of any kind suffered by any third party directly or indirectly caused by repairs or remedial work carried out without the Sellerʼs prior written approval and the Purchaser shall indemnify the Seller against any and all claims and costs arising out of such claims to the extent that such repairs or remedial work have been performed by the Purchaser or its agents.
(v) The Purchaser warrants that the goods will not be sold or distributed or otherwise dealt with unless the Purchaser has first applied to the goods such protective or other packaging and all such warnings, notices, statements or markings, and taken all such other precautions of whatsoever nature required by legislation and appropriate to preclude the making of any legal claim or prosecution on the grounds of failure to satisfy such legal requirements as may be in force from time to time, by any person who may use consume or be affected by the goods. The Purchaser shall fully indemnify the Seller against all claims, proceedings, costs and expenses in respect of any loss or damage of whatsoever nature suffered by the Seller or by any employee, former employee, beneficiary or contingent beneficiary of the Seller or of any other person or institution arising from any breach of this warranty or the use or misuse of the goods by the Purchaser or the Purchaserʼs employee, former employee, agent or sub-contractor. The Purchaser shall take out and maintain appropriate insurance cover against all liabilities that may arise under the terms of this indemnity and shall provide the Seller, upon request, with a certificate or other evidence of such insurance cover.
